Terms, Conditions, and Limited Warranty of Sale

  • All prices, terms and conditions of sale are subject to change without prior notice. Please call for current pricing.
  • Buyer agrees to all terms and conditions of seller upon the placement of any and all purchase orders.

Please Note

  • Drop shipments are available on a limited basis and only to select locations.
  • All claims for discrepancies or shortages must be made within ten (10) days of receipt of invoice.
  • Stock levels and delivery times vary, please allow plenty of time for shipment.
  • Special order items may not be cancelled except with the permission of National Vacuum Equipment.
  • National Vacuum Equipment reserves the right at all times to reject any and all orders for any reason.

All sales are cash sales unless credit has been established prior to placement of the order. Credit card transactions may be subject to a 3% process and handling fee.

Payment Terms to Approved and Qualified Accounts

  • Net 30 days.
  • We reserve the right to hold shipments of past due accounts.
  • Any account and payment discrepancies shall be settled in the court system of Grand Traverse County, Michigan.

Freight Terms

  • Freight will ship at the discretion of NVE, unless otherwise specified at the time the order is placed.
  • All freight charges are the responsibility of the buyer.
  • All shipments will be made F.O.B. shipping point. Shipments become the property of the purchaser at the time of delivery to the common carrier. All claims for freight damage are to be directed to the common carrier.
  • All prepaid and add motor freight shipments are subject to a prepayment fee.

Return of Goods

  • A Return Material Authorization (RMA) number MUST be obtained before returning any material for any reason.
  • Material returned for credit will be subject to factory inspection.
  • All material must be shipped with transportation charges prepaid.
  • Products which are made to special order or that are obsolete are not returnable.
  • Merchandise may only be returned provided that the material is in original condition.
  • Buyer will be charged a 15% restocking fee on returned merchandise.
  • No goods may be returned for any reason after 30 days from the original date of invoice.

Return of Defective Merchandise

  • Defective or failed material must be held at the buyer’s premises until authorization has been granted by seller to return the merchandise.
  • Merchandise which is returned for warranty inspection must be returned freight prepaid in the most economical way.
  • Credit based on prices at the time of purchase will be issued for material found to contain manufactures defect upon inspection.

Merchandise Shipped in Error

  • Buyer must notify National Vacuum Equipment immediately of any merchandise shipped in error.
  • On notification, merchandise is to be returned to NVE via truck on a freight collect basis, or via UPS on a freight collect basis.
  • Buyer will be reimbursed for cost of merchandise, plus any additional freight charges which have been incurred due to shipping error.
  • All claims for discrepancies or shortages must be made within ten (10) days from the original date of invoice.

Merchandise Ordered in Error

  • Merchandise may be returned provided that the merchandise is in original condition.
  • Merchandise must be returned freight prepaid and the buyer may be charged a 15% restocking fee.
  • Special orders cannot be returned.
  • No goods may be returned for any reason after 30 days from the original date of invoice.

Delivery Damages and Shortages

  • Delivery by NVE to the common carrier shall constitute delivery to the buyer.
  • NVE’s risk of loss due to damaged merchandise ends upon delivery of the merchandise to the common carrier. The buyer assumes all transportation risks from that point forward.
  • Transportation damage claims must be handled between the buyer and the freight or delivery company.

Statement of Guarantee and Liability

National Vacuum Equipment guarantees all manufactured products furnished by it to be free from defects in material and workmanship for a period of 1 – 2 year(s) from date of shipment from its warehouse or 1 – 2 year(s) from the original purchase date, depending on the product, and is subject only to the following:

  1. Manufacturer’s liability under this warranty (and under any other warranty expressed or implied, statutory or otherwise) is limited to repair, or at manufacturer’s option, replacement of all parts which are shown to have been defective when shipped, and then only if the manufacturer is notified of such defects within such warranty period and such defective parts are promptly delivered to its factory at 2707 Aero Park Drive, Traverse City, Michigan 49686, transportation charges prepaid. Manufacturer’s liability hereunder shall not be enforceable until such equipment has been fully paid for. Except to the extent expressly assumed herein, manufacturer’s liability for incidental and consequential damage is hereby excluded to the full extent permitted by applicable law. Manufacturer’s liability as stated herein cannot be altered or enlarged except by a writing signed by an officer of the manufacturer.
  2. Warranty is void if compatible components, or approved components of equal quality, are not used with the pump.
  3. Vane breakage or subsequent damage caused by vane breakage is not warrantable. 
  4. Damage caused by improper use or lack of proper maintenance is not warrantable. 
  5. Products manufactured by companies other than NVE are subject to the terms of their respective warranties. 
  6. Responsibility of Final Assembler. NVE goes to great lengths to ensure the quality and proper functionality of the products it supplies. Many products we supply are purchased for resale or are impossible or impractical to test prior to the installation of the item in a vacuum system. It is therefore the responsibility of the final assembler to thoroughly test the vacuum system and components supplied to the assembler by NVE prior to delivery of the final product to the end user. Any items found to be defective after delivery to the end user that should have been discovered prior to delivery will qualify for replacement of the defective part only with absolutely no compensation for outside labor or travel expenses. Any subsequent damage to other components caused by the defective part will be the sole responsibility of the assembler.
  7. NVE cannot guarantee the NVE valves against leakage once they are being used in the field. NVE Valves need to be installed in the proper manner according to the installation instructions.
